These Terms and Conditions constitute a legally binding agreement between you and Stepa Mobile FZE LLC regarding the "Aurora Forecast Map & KP Index" application. By accessing the service, you agree to comply with all applicable laws and regulations. If you do not agree with these terms, you are prohibited from using or accessing this service. We reserve the right to change these terms at any time without notice. Your continued use of the app signifies your acceptance of any updated conditions.
The Application is intended for users who are at least 13 years of age. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service. We do not knowingly provide services to individuals under the age of 13. Any account found to be in violation of these age requirements will be terminated immediately. Stepa Mobile FZE LLC assumes no liability for misrepresentation of age by any user.
The App uses Artificial Intelligence to identify and predict celestial events based on telemetry data. You acknowledge that AI models are probabilistic and may produce "hallucinations" or incorrect identifications. These results are for educational and entertainment purposes only and should not be used for professional astronomy or navigation. We do not guarantee that any identified object is accurately classified. You agree to use the AI features at your own risk and discretion.
Astronomical events are subject to atmospheric conditions, light pollution, and orbital shifts. While our algorithms strive for accuracy, we do not warrant that notifications will coincide perfectly with actual events. Delays in data processing or server synchronization may lead to missed observations. Stepa Mobile FZE LLC is not responsible for any disappointment or loss resulting from inaccurate timing. We recommend cross-referencing our data with official astronomical institutions.
To track the sky, the App requires access to your device's GPS, compass, and gyroscope. The precision of the sky map depends entirely on the quality and calibration of your mobile hardware. Magnetic interference from buildings or electronic devices can cause significant errors in object positioning. You are responsible for ensuring your device is properly calibrated. We are not liable for malfunctions caused by hardware limitations or environmental interference.
All financial transactions are processed through the Apple App Store payment system. By making a purchase, you agree to Apple’s terms regarding billing and payment processing. Stepa Mobile FZE LLC does not store or have access to your credit card details. All billing disputes must be handled directly through Apple Support. We reserve the right to change our pricing models or feature tiers at any time.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current cycle. You can manage or cancel your subscription in your iTunes Account Settings after purchase. No refunds are provided for the unused portion of a subscription period. Please monitor your subscription status to avoid unwanted charges.
As per Apple’s standard policies, Stepa Mobile FZE LLC cannot directly issue refunds for in-app purchases. If you seek a refund, you must contact Apple Inc. through their official "Report a Problem" portal. We do not have the technical ability to override Apple's refund decisions. You acknowledge that all sales are final through the App Store ecosystem. This policy is non-negotiable and applies to all premium features.
All code, graphics, UI designs, and AI algorithms are the exclusive property of Stepa Mobile FZE LLC. You are granted a limited, non-transferable license to use the app for personal, non-commercial use. You may not copy, modify, or redistribute any part of our intellectual property. Any unauthorized use will result in the immediate termination of your license. We protect our proprietary technology through international copyright and trademark laws.
You agree not to attempt to decompile, reverse engineer, or extract the source code of the Application. Use of automated systems or "bots" to scrape data from the App is strictly prohibited. You may not use the Service to build a competing product or service. Any attempt to bypass security measures or access unauthorized data will be prosecuted. We reserve the right to block IP addresses that show suspicious activity.
If you upload photos or provide feedback, you grant us a worldwide, royalty-free license to use that content. This includes using anonymized images to train and improve our AI models. You represent that you own the rights to any content you submit to the App. We are not responsible for content posted by other users. We reserve the right to remove any content that violates our community standards.
By using the App, you consent to receive push notifications regarding celestial events. While we strive for reliability, we do not guarantee the delivery of these alerts. Network issues, battery-saving modes, or system settings may prevent you from receiving notifications. You agree that Stepa Mobile FZE LLC is not liable for any missed events due to notification failure. You can toggle these alerts in the settings menu at any time.
We rely on external APIs for weather data, orbital elements, and satellite tracking. We do not control these third-party services and cannot guarantee their uptime or accuracy. Any outage on their end may temporarily disable certain features of the App. Your use of third-party data is subject to their respective terms and conditions. Stepa Mobile FZE LLC disclaims all liability for errors originating from these external providers.
The App requires an active internet connection to download AI updates and real-time astronomical data. You are responsible for any data charges incurred from your mobile carrier. High-resolution sky maps and AI processing may consume significant amounts of data. We recommend using Wi-Fi for the best experience and to avoid overage fees. We are not responsible for any costs related to your internet service provider.
Real-time AR features and background tracking can significantly drain your device's battery. You acknowledge that continued use of the App may impact device performance and temperature. We suggest monitoring your battery levels while using the sky tracker in the field. Stepa Mobile FZE LLC is not liable for device shutdowns or hardware wear caused by intensive app usage. Use the background tracking features with caution.
We reserve the right to terminate or suspend your access to the App without prior notice for any violation of these terms. Upon termination, your right to use the Service will immediately cease. We may also discontinue the App or any specific feature at our sole discretion. Any fees paid up to the point of termination are non-refundable. Termination does not waive any legal rights held by Stepa Mobile FZE LLC.
To the maximum extent permitted by law, Stepa Mobile FZE LLC shall not be liable for any indirect or incidental damages. This includes loss of data, loss of equipment, or physical injury during nighttime observations. We are not responsible for accidents that occur while you are looking at your screen instead of your surroundings. Always be aware of your environment while using the App at night. Our total liability shall not exceed the amount you paid for the App.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the App will be error-free or that its functions will meet your requirements. Your use of the software is at your own risk. No oral or written information provided by us shall create a warranty.
You agree to indemnify and hold Stepa Mobile FZE LLC harmless from any claims, losses, or expenses arising from your use of the App. This includes legal fees resulting from your violation of these Terms or the rights of any third party. We reserve the right to assume the exclusive defense of any matter subject to indemnification by you. This obligation will survive the termination of your account or use of the Service. You agree to cooperate fully in the defense of any such claim.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Stepa Mobile FZE LLC is registered. Any legal action regarding these Terms must be filed in the competent courts of that region. You consent to the personal jurisdiction of such courts for the purpose of litigating any such claim. This ensures a consistent legal framework for all our global users. Conflict of law principles shall not apply to this agreement.
Any dispute arising from these Terms shall first be attempted to be resolved through informal negotiations. If a resolution is not reached within 60 days, the dispute shall be settled by binding arbitration. You waive your right to a trial by jury and to participate in any class-action lawsuit. Arbitration shall take place in a location determined by the Company. The arbitrator's decision shall be final and binding on both parties.
If you access the Service from outside our primary jurisdiction, you are responsible for compliance with local laws. We make no representation that the App is appropriate for use in all countries. Some features may be restricted due to local regulations regarding AI or data encryption. You agree not to use the App in any country subject to international sanctions. We reserve the right to limit the availability of our Service to any geographic area.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be replaced by a valid one that most closely matches the intent of the original. This ensures that the overall agreement remains legally sound and functional. Our failure to enforce any right or provision will not be considered a waiver of those rights. This agreement represents the entire understanding between you and the Company.
These Terms, along with the Privacy Policy, constitute the entire agreement between you and Stepa Mobile FZE LLC. They supersede any prior agreements, oral or written, regarding the use of the Application. No modification to this agreement shall be binding unless made in writing and signed by an authorized representative. Any ambiguity in these terms shall not be construed against the drafting party. You may not assign your rights under this agreement to any third party.
Stepa Mobile FZE LLC shall not be liable for any failure to perform its obligations due to causes beyond its control. This includes natural disasters, server outages, pandemics, or government interference. In such events, our performance under these terms is suspended for the duration of the event. We will make reasonable efforts to restore service as soon as possible. You acknowledge that celestial events are also subject to nature and are not under our control. Force majeure events do not entitle users to refunds.
Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect and use your personal information. By agreeing to these Terms, you also consent to our data practices. If there is a conflict between these Terms and the Privacy Policy, the Terms shall prevail regarding service usage. We take your privacy seriously and implement high-level security protocols. Our data processing is limited to what is necessary for sky tracking.
We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. This includes the removal of specific AI features or astronomical databases. We are not liable to you or any third party for any modification or price change. We may release updates that are mandatory for continued use of the Service. You agree to download and install all updates to ensure the security and stability of the App. Regular maintenance may cause temporary downtime.
Any suggestions or feedback you provide to us shall be deemed non-confidential. Stepa Mobile FZE LLC is free to use such information on an unrestricted basis for any purpose. This includes improving the AI model or developing new astronomical features. You will not be entitled to any compensation for suggestions that we implement. By submitting feedback, you waive any moral rights to the ideas presented. We value user input as a way to refine our celestial tracking capabilities.
Using the App at night requires careful attention to your physical surroundings. You agree not to use the App while driving, operating machinery, or walking in dangerous areas. We are not responsible for any injuries sustained while observing the sky (e.g., trips, falls, or wildlife encounters). We recommend using a red-light filter mode to preserve your night vision and enhance safety. Always tell someone your location if you are observing in remote areas. Safety is your primary responsibility during use.
We may offer "Beta" or experimental features that are still under development. These features are provided for testing purposes and may contain significant bugs or inaccuracies. You use Beta features at your own risk and acknowledge they may not perform as expected. We may collect additional telemetry data from Beta features to improve their stability. We reserve the right to remove Beta features at any time without notice. Feedback on these features is highly encouraged but not compensated.
If the App requires an account, you are responsible for safeguarding your login credentials. You must notify us immediately of any unauthorized access to your account. Stepa Mobile FZE LLC is not liable for losses caused by unauthorized use of your account. We recommend using a strong, unique password and enabling two-factor authentication if available. Sharing accounts between multiple users is strictly prohibited. We reserve the right to reset passwords for security reasons.
We respect the intellectual property rights of others. If you believe that any content in the App infringes on your copyright, please contact [email protected]. You must provide a detailed description of the alleged infringement and your contact information. We will investigate the claim and take appropriate action in accordance with the DMCA and other laws. This includes removing infringing material or disabling the accounts of repeat offenders. We strive to maintain a platform that respects all creators.
Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and us. You are an independent user of the software, and we are an independent service provider. You have no authority to bind Stepa Mobile FZE LLC to any contracts or obligations. Our relationship is strictly that of a developer and a licensed user. This agreement does not grant you any rights to represent our brand or company. We operate independently in all business and legal matters.
These Terms are for the sole benefit of you and Stepa Mobile FZE LLC and their respective successors. No third party shall have any right to enforce any of these provisions. This ensures that our legal relationship remains private and manageable. Any rights granted to you are personal and cannot be assigned to others. Third-party providers mentioned in these terms are not parties to this specific agreement. Our obligations are limited to the registered user of the Application.
The Application and its underlying technology may be subject to export control laws. You represent that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country. You agree to comply with all domestic and international export laws and regulations. You shall not export or re-export the software without proper government licenses. Failure to comply with export laws will result in immediate termination of service. This is a critical requirement for international software distribution.
Sections related to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive the termination of these Terms. This means that even if you stop using the App, your previous obligations and our legal protections remain in effect. This is necessary to protect the Company from claims arising from past usage. Your agreement to arbitrate disputes also survives termination. All licenses granted to the Company for user content remain in force. This ensures long-term legal stability for our business.
Our failure to exercise or enforce any right under these Terms shall not constitute a waiver of such right. Any waiver must be provided in writing by an authorized officer of Stepa Mobile FZE LLC to be valid. A waiver of a breach in one instance does not constitute a waiver of any subsequent breach. We maintain all legal rights even if we choose not to exercise them immediately. This provision prevents any misunderstanding regarding our enforcement policies. Consistency in enforcement is at our sole discretion.

We are constantly improving "Aurora Forecast Map & KP Index" and may add or remove features without notice. You acknowledge that the version of the App you download today may change significantly over time. We are not obligated to maintain support for older versions of the software or specific mobile devices. We recommend enabling automatic updates to ensure you have the latest AI models and sky data. Continued use of the App after an update constitutes acceptance of the new features. We strive to keep our community informed of major changes.
